Portrait Contract


Before the session is booked, Client must make a deposit of 50%. The deposit is not refundable if Client cancels or changes the arrangement. The remaining 50% is expected no later than the beginning of the session. Method of payment is personal check, cash, Venmo or PayPal. Bounced checks will incur an additional $40 fee. Photographer will contact Client for confirmation of service; if Client does not respond to confirmation by 24 hours before service, Photographer has the option to cancel the service and retain the deposit. If Client arrives to the agreed upon location 15 minutes after the agreed upon time, Photographer has the option to cancel the service and retain the deposit. Any time beyond the agreed upon starting time will be compensated as such. If Photographer is unable to appear for the date listed above, the deposit shall be refunded to Client.

Client shall reimburse Photographer for any additional costs Photographer may incur for travel, tolls, meals, parking, and other reasonable costs necessary to the performance of these services.

Photographs shall be available to Client via private gallery on website. Photographer retains copyright in the photographs, and hereby grants Client unlimited but non-exclusive rights to use or reproduce the photographs for which Client pays.

Client is prohibited from altering the photographs in any way. This includes but is not limited to changing the filters, drawing on or adding text to the photographs, removing or covering up the copyright, or cropping the picture (unless required for printing purposes). (Photographer is aware and accepts that certain social media websites require pictures to be cropped, such as Instagram and Facebook profile pictures). Client is to ask Photographer to make any changes.

Client shall assist and cooperate with Photographer in obtaining the desired photographs, including but not limited to specifying persons and/or scenes to be photographed, taking time to pose for photographs at Photographer’s direction, etc. Photographer shall not be responsible for photographs not taken as a result of Client’s failure to provide reasonable assistance or cooperation.
